Starting January 1, 2023, the definition of a family member will also include a designated person under the Healthy Workplaces, Healthy Families Act (HWHFA). Presently, the HWHFA specifies that a family member comprises of a child, grandparent, grandchild, sibling, spouse, or domestic partner. The newly expanded definition of a family member will allow employees to take paid sick leave in caring for a person that the employee has identified when the employee requests leave. This can be limited by employers to one designated person within a twelve-month period for paid sick leave days.
